The European Union has issued a new regulation regulating the origin of solar modules made of crystalline silicon. Regulation (EU) 1357/13 of 25.12.2013 redefines the rules of origin for CN codes ex 8501 and ex 8541.

This change is particularly relevant with regard to the anti-dumping measures on solar modules originating in China. This is because a definitive anti-dumping duty is imposed on solar modules and solar panels originating in China.

The new regulation specifies in more concrete terms in Art. 24 of the Customs Code which step in the production of photovoltaic modules or panels is the decisive manufacturing step that determines the origin of the solar modules.

Anyone importing solar modules should therefore now check whether the amendments to the new regulation affect them.
