EU Regulation 1194/2013 imposes a definitive anti-dumping duty on imports of biodiesel from Argentina and Indonesia. Tariff surcharges are 24.6% for imports from Argentina and 18.9% for imports from Indonesia. This regulation will apply for an initial period of five years and is intended to eliminate a threat to the green energy sector in Europe.
The Commission asserts that the anti-dumping duties have been calculated on the basis of the lower injury margin and not the higher dumping margin. It should be demonstrated that biodiesel from Argentina and Indonesia is still desired in the EU.
The parallel anti-subsidy investigation procedure was discontinued.
