With the Implementing Regulation (EU) 2018/640, the EU Commission has approved the monitoring of imports of aluminium products, which will take effect on 12 May 2018.
Background to the Implementing Regulation
The background to the Implementing Regulation (EU) 2018/640 is the difficult economic situation of the aluminium industry within the EU due to the oversupply of aluminium products worldwide. This is exacerbated by additional US tariffs which affect the market and there are fears of future injury to EU producers. The Commission’s implementing regulation therefore seeks to protect Union producers in the aluminium sector.
Content of the Implementing Regulation
The implementing regulation will monitor aluminium products originating from non-EU countries (except Iceland, Liechtenstein and Norway) from 12 May 2018 until 15 May 2020 inclusive. Products weighing no more than 2,500 kg net shall also be excluded from monitoring.
Monitoring document as a mandatory import criterion
During the above monitoring period, the presentation of a control document is a necessary import criterion for the import of aluminium products. These monitoring documents can be submitted online on the website of the Federal Office of Economics and Export Control (ELAN), but can also be requested by fax or mail. When submitting an application by post or fax, however, care must be taken to ensure that the relevant E 3c form, the annex to the surveillance document and a copy of the purchase contract or the invoice and packing list are sent.
